Counsel for Surinder Kumar Khosla on Monday moved an application before the Mapusa court seeking to tag the proclamation proceedings with
the Birch by Romeo Lane fire case in which Anjuna police have filed a chargesheet against 13 accused, including Khosla, who owns the property on which the club stood.
The court has asked the prosecution to file its reply and adjourned the matter to April 7.
During the hearing, counsel for Khosla, Adv Sebastian Vales, urged the court to tag both cases together. He requested that the matter relating to
the chargesheet filed by Anjuna police against his client be heard along with the criminal revision application challenging the proclamation notice, as both matters are being heard by the same court.
Following the submission, the court directed the prosecution to file its reply to the application.
Speaking to the media, Vales said, “The issues are interlinked between our proclamation matter and the matter in the chargesheet filed against my client, so we requested to tag both matters and hear them together. Besides, we have also sought time to file a rejoinder in the case to deal with the contents of the police say.”
He further said, “During the hearing, the public prosecutor informed the court that there was a technical problem with the issue of the proclamation notice to Khosla and showing him as absconding as the required 30-day mandatory period was not fulfilled.”
It may be recalled that Vales had earlier challenged the proclamation notice issued to Khosla and pasted the same on his door. During an earlier hearing, Vales had said that the notice had surprised his client as he had been participating in the proceedings initiated by the police. Police had issued notice under Section 35(3), and representation had been given by Khosla through his lawyer.
