Birch fire: HC cancels bail of Luthras, Gupta

Panaji: The High Court of Bombay at Goa has cancelled the bail granted to Birch by Romeo Lane co-owners Saurabh Luthra, Gaurav Luthra and Ajay Gupta in connection with the December 6, 2025, nightclub fire at Arpora that claimed 25 lives.

The High Court directed the three accused to surrender within two weeks, while granting them liberty to file fresh bail applications before the trial court, which has been directed to decide any such application within two weeks of filing the same.

The Goa government had challenged the trial court orders granting bail to the trio in both, the Anjuna police fire case and the connected Mapusa police case.

The Mapusa police case involved alleged forgery of a health NOC to obtain an excise licence for the club.

During arguments, the prosecution highlighted the conduct of the accused following the fire. It was submitted that the Luthra brothers travelled to Phuket after the incident, while Gupta left for Delhi.

Meanwhile, in suo motu proceedings related to the nightclub fire at Arpora, amicus curiae placed a detailed note of various issues before the court. A counsel for the village panchayats of Keri, Mandrem and Morjim confirmed that their documentation was already on record. The court also noted the presence of secretaries from these panchayats during the hearing.

Furthermore, the state government requested time to file a reply in a related miscellaneous application, while the Colva village panchayat confirmed their affidavit was submitted on August 7. The bench has scheduled the next hearing for September 1, 2026.
