Ensure footpaths are free around Old Goa church complex: HC

The High Court of Bombay at Goa has directed the Se Old Goa panchayat to clear footpaths in the vicinity of the Old Goa church complex that have been encroached upon by stalls and carts.

“We deem it appropriate that the panchayat should enforce this court’s March 6, 2025 order and ensure that all footpaths in the vicinity of the church complex are kept free from any moving carts, permanent structure or temporary structures,” the High Court said.

The court directed the panchayat secretary to ensure its directions are enforced and to submit a compliance report by May 4.

One of the issues in the petition relates to the panchayat’s implementation of the court’s earlier judgment in a suo motu public interest litigation, wherein it was directed that all footpaths be kept free for pedestrian thoroughfare.

The panchayat has placed on record showcause notices issued to handcart owners who were given licences to operate along footpaths in the vicinity of the church complex.

The petition alleged misuse of handcart licences to erect permanent structures.

The court said that as none appeared for the panchayat, the Registrar (Judicial) should communicate the order to the panchayat by email.
