‘Superannuation age of 65 applies to AICTE teachers, not librarians’

The High Court of Bombay at Goa has ruled that the All India Council for Technical Education Regulations, 2019, prescribing superannuation age of 65 years, apply only to teaching faculty and principals and cannot be extended to librarians.

A case was filed by Calvin S Mota Peroz of Margao, librarian at Agnel Polytechnic since 1991, who is due to retire on August 31.

He contended that since the institution is AICTE-approved and government-aided, his service conditions should be governed by AICTE regulations, including retirement at 65.

The HC disagreed, stating, “We are of the considered opinion that the petitioner, being a librarian in a government-aided polytechnic, is governed by the service conditions notified by the
state government.”

The court also noted that at the time of his appointment in 1991, the retirement age was 58, later revised to 60 in line with policy for government-aided institutions. It held that the petitioner could not claim an extension up to 65 when such a benefit had not been extended to his cadre nor notified by the state.
