The South Goa District and Sessions Court has convicted and sentenced Kenyan national Joseph Achola Ouma (56) to undergo rigorous imprisonment for 10 years in the 2019 drugs case of Canacona police.
Ouma was apprehended with cocaine and LSD in January 2019.
“The prosecution has proved that the drug and the substance were found in possession of the accused. He has failed to show any document to prove the contrary. There are no contradictions or omissions brought on record by the advocate for the accused. Hence, considering the evidence on record and the documents produced, the prosecution has proved the case,” observed Kshama Joshi, Additional Sessions Judge, South Goa, Margao in an order issued recently.
The accused was ordered to undergo rigorous imprisonment for 10 years and to pay a fine of Rs 1 lakh and, in default, two years for the offence punishable under Section 22 (c) of NDPS Act, and to undergo five years of rigorous imprisonment and to pay a fine of Rs 50,000 in default to undergo imprisonment for one year for the offence under S21 (b) of NDPS Act. The substantive sentences shall run concurrently, observed the judge.
The accused was in custody on January 29, 2019.
The sentence undergone by the accused is ordered to be set off.
The case was initially investigated by PSI Damodar Shirodkar and later by PSI Ramesh Shirodkar (now PI EOC), who subsequently filed the chargesheet.
