The High Court of Bombay at Goa on Monday issued a notice to the state government on a PIL filed by Diksha Vaigankar of Sankhali challenging Section 38A of the Goa Land Revenue Code.
The matter will be heard further in February.
Section 38A, enacted in 2025, provides a mechanism to regularise unauthorised dwelling houses on government land built before February 28, 2014.
The court also tagged Vaigankar’s PIL with three PILs filed by activist Kashinath Shetye, who has challenged the state’s move to regularise unauthorised structures on comunidade, government and private lands under the Mhaje Ghar housing scheme.
The court granted the government additional time to file its affidavit. The matter has been adjourned to February 3, 2026.
The petitions allege the scheme facilitates legalisation of illegal constructions and violates land management norms, arguing that it is being misused to legitimise encroachments.
