The High Court of Bombay at Goa has directed the Goa State Pollution Control Board (GSPCB) to inspect the Jaelynn Infra Pvt Ltd plant after the installation of the ambient air quality monitoring system. The court further ordered that the plant be desealed for this limited purpose and a report be submitted to the court immediately.
The company had challenged the GSPCB’s January 10 order, which directed the immediate closure or suspension of the plant’s operations until it complied with anti-pollution measures. The GSPCB had sealed the premises due to the non-functioning of the monitoring system.
During the hearing, the petitioner’s counsel informed the court that a new ambient air quality monitoring system had been ordered and would be installed promptly. For this purpose, the GSPCB was directed to deseal the premises temporarily.
However, the respondent’s advocate raised concerns about other non-compliance issues, including the installation of wind-breaking walls (metal sheets) as mandated by the GSPCB. The petitioner’s counsel cited safety concerns as a reason for the delay but mentioned that bamboo plantations had already been planted as a temporary measure. The High Court instructed the Pollution Control Board to consider an alternative solution for the wind-breaking walls and brought the issue to their attention. Additionally, during a previous hearing, the court had reviewed a report from the Tamil Nadu Pollution Control Board on ready-mix concrete plants, which classified the industry as an air-polluting one and led to the creation of guidelines for such plants.
