Aldona Congress MLA Carlos Ferreira on Tuesday criticised Mapusa Police for registering an FIR against the youth who died by suicide in Mapusa
for alleged possession of an illegal weapon, describing the move as an act of “additional malice”.
“I told the SP that in criminal jurisprudence you don’t file an FIR against a dead person. It is not possible. What is the purpose of an FIR? It is to register an offence, it is to investigate the crime and to punish the accused by prosecution. If the accused is dead, there is no question of an FIR,” he said.
“I could have understood if they had said the FIR
was for the illegal possession of a firearm by unknown persons.”
Ferreira said that this was quite a serious matter as it exhibits either a complete lack of knowledge of criminal law, or a deliberate malicious attempt to tarnish the youth’s name and
make it appear as if he was a criminal. “The registration of the FIR is malicious because once you have a cognisable offence with a non-cognisable offence, then it is treated as cognisable. To register it as an FIR they added this section,” he said.
