IGP authorised to intercept digital data in emergencies

The state government, under the Information Technology Act, has authorised the Inspector General of Police (IGP) to intercept, monitor and decrypt any information generated, transmitted, received or stored in any computer resource, only in case of emergencies.

In an order issued, the Home Department has said that all such cases of interception, monitoring and decryption of any information should be informed in writing to the Home Secretary within three working days. It has said that an approval of the Home Secretary should then be obtained within a period of seven
working days.

“In case approval is not obtained, such interception, monitoring or decryption shall cease and the information shall not be intercepted or monitored or decrypted thereafter without prior approval of the Home Secretary,” states the order.

The order was issued in exercise of the powers conferred by sub-section (1) of Section 69 of the Information Technology Act, 2000 (Act 21 of 2000) read with Rule 3 of the Information Technology (Procedure and Safeguards for Interception, Monitoring and Decryption of Information) Rules, 2009.
