Implement SC order, state circulars on bldg norms: HC

The High Court of Bombay at Goa on Monday disposed of a petition concerning guidelines issued by the Supreme Court on norms to be followed
while granting construction permissions, directing authorities concerned to take immediate steps to implement the judgment and related circulars in letter and spirit.

In its December 17, 2024, order, the Supreme Court issued certain guidelines pertaining to norms to be adhered to while granting permission for constructions and other ancillary matters. These guidelines are required to be followed by all states, including Goa.

Accordingly, the Directorate of Panchayats; the Department of Urban Development; and the Chief Town Planner issued circulars on May 9, 2025, January 14, 2026, and January 14, 2026, respectively, instructing implementation of the Supreme Court order.

The grievance of the
petitioner, Agnelo Francis Baretto, was that despite issuance of these circulars specifically indicating the guidelines laid down by
the apex court, no action had been taken by the respondents, including the Chief Secretary, to implement the judgment and/or the circulars.

The High Court said that after going through the SC order and the three circulars issued by the state authorities, it was of the view that the direction as prayed for by the petitioner could be granted.

It said that a copy of the order is to be circulated to all departments concerned to implement the guidelines issued by the Supreme Court.
