Goa records first full-trial conviction under BNS

In what is considered the first conviction in the state after a full-fledged trial under the Bharatiya Nyaya Sanhita (BNS), 2023, the Judicial Magistrate First Class (JMFC) at Mapusa convicted an Arpora resident for stalking, house trespass and criminal intimidation, sentencing him to simple imprisonment.

The court also imposed fines totalling Rs 35,000 to be paid to the victim as compensation. A complaint was lodged on May 26, 2025 by an Arpora resident against Sarvesh alias Muru alias Babu for stalking
and house trespass.

The prosecution case stated that on May 24, 2025 the accused, armed with a sickle, trespassed into the complainant’s residence and attempted to assault her, wrongfully restrained her and verbally abused her and issued threats of rape, along with threats to kill the complainant’s family members.

Anjuna police filed a chargesheet. Judge Akshata Kale on Tuesday convicted the accused under Section 78 of the BNS (stalking) and sentenced him to simple imprisonment for three years and a fine of Rs  15,000, with a default sentence of nine months’ imprisonment.  Under Section 79 of the BNS (insulting the modesty of a woman), the accused was directed to pay a fine of  Rs 10,000, with a default sentence of six months’ imprisonment. The court further convicted the accused under Section 333 of the BNS (house trespass) and sentenced him to simple imprisonment for one year along with a fine of Rs  10,000, with a default sentence of six months’ imprisonment.

The case was prosecuted by Assistant Public Prosecutor Tejas Chodankar, with investigation carried out by PSI Saish Kinlekar.
