Goa to bring in Maharashtra-like law to fix housing title disputes

Chief Minister Pramod Sawant on Thursday assured the Goa Legislative Assembly that the state will introduce a legislation similar to the Maharashtra Ownership Flats Act (MOFA), 1963, to provide relief to the owners of premises in buildings and housing societies, the title of which hinges on an agreement of sale.

“We will bring in an ordinance before the next session of Goa Legislative Assembly and pass the Act in the next session. Within the next three months – Law Department, Cooperation Department and Revenue Department will study the existing issues,” Sawant said.

He was responding to a Calling Attention moved by Aldona Congress MLA Carlos Ferreira.

Sawant earlier said show cause notices had been issued to all co-ownership and co-partnership housing societies, asking them to submit conveyance deeds executed in their favour. However, in many cases the whereabouts of the landlord or the builder is
not known  in some cases the landlord is deceased and in some cases the builder or landlord is not cooperating.

“Concessions in stamp duty and registration fees have been granted. However, societies could not avail the benefits due to the above problems,” Sawant said, adding that an amnesty scheme has been announced for such housing societies.
